Elements of Byron Competition Terms & Conditions

This is a game of skill. Chance plays no part in determining the winner. Each entry will be individually judged, based upon individual creative merit. All entries must be an independent creation by the entrant and free of any claims that they infringe any third-party rights. Entries must not have been published previously and/or have been used to win prizes in any other competitions.

Employees of the promoter (Sitchu) and agencies associated with this promotion are ineligible to enter the competition, as are their immediate families.

To enter, entrants must sign up to the promotors (Sitchu) and competition partner mailing lists (Elements of Byron) by completing the competition entry form and answering the 25 words or less question here. Only one entry is permitted per person. The Promoter reserves the right to verify the validity of entries.

The judges reserve the right to disqualify any entrant submitting an entry which, in the opinion of the judges, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. The judges’ decision will be final and no correspondence will be entered into.

All entries become and remain the property of the promoter (Sitchu) and agencies associated with this promotion (Elements of Byron).

Winners of the competition must be 18 years old and over and residents of Australia.

The promoter reserves the right to withdraw or amend the competition as necessary due to circumstances outside its control.

The prize is non-transferable and non-redeemable for cash. Any attempt to resell or auction all or any part of this prize will result in an immediate cancellation of the prize. In the event that, for any reason whatsoever, a winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

The promoter reserves the right to substitute any component of the prize for an itinerary of equal value at their discretion.

Prize winners will be required to agree to the terms of the prize offering, otherwise prize will be forfeited.

Once prize has been confirmed by Sitchu, the prize is deemed non-transferrable.

The Prize is subject to availability and is comprised of: Two night stay in a 2 bedroom superior villa for four people with $500 resort credit which can be used on food and beverage (includes Azure Bar and Grill, Summer Salt, Breeze Café or In Room Dining) or a treatment at Osprey Spa at Elements of Byron. 

The total prize value is AU$3,500.

The Prize must be booked by calling the resorts in-house reservations team on 02 6639 1565 and quoting the voucher number.

Voucher must be used in a single stay.

Voucher expires and must be used in full by 31 August 2026 (strictly no extensions, regardless of circumstance).

Blackout dates apply:19 Dec 25 – 31 Jan 2026; 3 Apr – 28 Apr 2026. 

Prize does not include flights, transportation, or any associated travel costs. The winner is solely responsible for arranging and covering all travel expenses required to redeem the Prize. Sitchu accepts no liability for any costs, damages, or losses incurred in relation to travel or transportation.

All bookings are subject to availability and at the hotel’s discretion based on occupancy levels.

The prize will be considered fully redeemed once a qualifying booking is made and confirmed as available. The prize will not be reinstated, refunded, or replaced if the reservation is cancelled or changed.

There is no residual value, and no credit will be issued if the booking amount is less than the prize value.

Persons under 18 are not eligible to enter. If a winner is found to be under 18 at any point (either when entering or winning), they will be automatically disqualified.

The prize awarded may not be exactly as illustrated in displays or marketing for the Competition.

The promoter shall not be liable for any loss or damage whatsoever which is suffered (including, but not limited to, indirect or consequential loss) or for personal injury which is suffered or sustained, in connection with the prize, except for any liability which cannot be excluded by laws.

The prize is for one time use and can not be exchanged for cash.

Promotion commences 5/06/25. Entries close 11.59 pm 19/06/25.

By entering the competition, all entrants will be deemed to have accepted and agreed to be bound by these rules.

The information you are asked to provide to Sitchu is personal information and is protected by the Privacy Act 1988. Sitchu and Elements of Byron may use the entrants names and literary pieces for any commercial purpose, including for future promotional marketing and publicity purposes. Literary pieces will be published in an anonymised format.

In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.

It is a condition of entry that the entrant consents to the Promoter using the entrant’s name, likeness, image and/or voice in the event they are a winner of a Prize (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of the Competition (including any outcome), and promoting any products and services, distributed and/or supplied by the Promoters.

By entering the Competition, an entrant releases and indemnifies the Promoter (including its officers, employees and agents) from and against all actions, liabilities, penalties, claims or demands the entrant may have against the Promoter or that the Promoter may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an entrant entering or participating in the Competition or winning or failing to win a prize, or using or permitting any other person to use the prize, except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable.

Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

In the event that for any reason whatsoever a winner does not accept the prize at the time stipulated by Sitchu then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.

Entries will be judged at Sitchu Head office at 10:00am AEST on 20/06/25 and the winner’s name will be published on Sitchu within 30 days of the draw.

The winner will be notified in writing by email within thirty (30) working days of the conclusion of the competition. Sitchu will be in contact with the winner to arrange prize fulfilment once prize is awarded by Sitchu. Sitchu or the partner brand do not hold any responsibility for lost/damaged goods.

If Sitchu is unable to contact the winner within 30 days of the draw and Sitchu has made every effort to contact them with the information provided by the entrant then Sitchu will award the prize to another valid entrant.
